ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT

In consideration of being permitted to participate in the Slugger Athletics Kickball League ("the League"), I, on behalf of myself, my heirs, personal representatives, executors, administrators, and assigns, acknowledge, appreciate, and agree that:

1. Assumption of Risk

Kickball and related activities involve inherent risks of physical injury, including but not limited to: sprains, strains, fractures, lacerations, contusions, concussions and other head and brain injuries, dental injuries, joint and ligament damage, heat and cold-related illness, cardiac events, transmission of communicable diseases, permanent disability, paralysis, and in rare instances, death. I knowingly and voluntarily assume all such risks — both known and unknown, foreseen and unforeseen — including those arising from the ordinary negligence of the Releasees (as defined below).

2. Release of Liability

I hereby release, waive, discharge, hold harmless, and covenant not to sue the League, Slugger Athletics LLC, its owners, organizers, officers, employees, coaches, referees, volunteers, sponsors, field owners and operators, and any affiliated persons (collectively "Releasees") from any and all liability, claims, demands, actions, causes of action, costs, and expenses, including attorneys' fees, of any kind whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by me or any of my property, while participating in League activities or while on the premises of any League event. This release applies to claims based on the ordinary negligence of any Releasee.

3. Indemnification

I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs (including attorneys' fees) they may incur arising out of my participation, my breach of this agreement, or my violation of any law or rule.

4. Medical Treatment Authorization

I authorize League organizers to obtain emergency medical treatment on my behalf if I am unable to consent. I understand that the League is not obligated to provide medical care and I am solely responsible for any costs of medical treatment, ambulance, or hospital services.

5. Fitness to Participate

I represent that I am in good health and physically able to participate. I am not aware of any medical condition, injury, or impairment that would increase my risk of injury or affect my ability to participate safely. I am responsible for consulting a physician before participating if I have any concerns.

6. Concussion & Head Injury Acknowledgment

I understand that concussions and other head injuries can occur in kickball and that the symptoms may not appear immediately. I agree to remove myself from play and seek medical attention if I experience any symptoms of a head injury, and to follow all return-to-play protocols.

7. Communicable Disease Acknowledgment

I understand that participation in group sports involves close contact with others and carries an inherent risk of exposure to and transmission of communicable diseases (including but not limited to influenza, COVID-19, and similar viruses). I voluntarily assume this risk.

8. Personal Property

The League is not responsible for any lost, stolen, or damaged personal property. I am solely responsible for safeguarding my belongings.

9. Insurance

I acknowledge that the League does not carry medical or accident insurance for participants. I am solely responsible for maintaining my own health insurance and any costs related to injury or illness.

10. Severability & Governing Law

If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force. This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute shall be brought in the state or federal courts located in Florida.

LEAGUE RULES — PLAYER CODE OF CONDUCT

By signing below, I agree to abide by the following rules:

1. Respect — Treat all players, coaches, referees, and field staff with respect. Zero tolerance for harassment, slurs, or discriminatory behavior.
2. Sportsmanship — No fighting. No arguing with refs beyond a polite question. Decisions are final.
3. Alcohol — Drinking on the field is prohibited unless expressly permitted by the venue. No one visibly intoxicated may play.
4. Clean up after yourself — Take your trash with you. Leave the field as you found it.
5. Equipment — Appropriate athletic footwear required. No metal cleats.
6. Gameplay — Follow the posted rulebook. Intentional dangerous play (headshots, aggressive sliding into fielders, etc.) results in ejection.
7. Ejection — Players ejected for violent conduct may be banned from future events at the organizer's sole discretion. No refunds for ejections.

MEDIA RELEASE

I grant Slugger Athletics LLC and the League permission to use, reproduce, and distribute photographs, video, and audio recordings taken at League events that include my likeness, for promotional, marketing, and editorial purposes — including social media, website, and print — in perpetuity and without compensation.

ACKNOWLEDGMENT

By typing my full legal name, drawing my signature, and submitting this form, I confirm that:

• I have read, understood, and voluntarily agreed to every provision above.
• I had the opportunity to ask questions and to seek legal counsel before signing.
• My electronic signature is the legal equivalent of a handwritten signature under the federal ESIGN Act and state UETA laws.
• This agreement is binding on me, my heirs, personal representatives, executors, administrators, and assigns.
